As English and Scottish law was only split recently, the need of the Scottish ammendment would suggest that Health and Safety Legislation would not cover this.

I am no legal expert but I believe it would be a similiar situation as to concerts/nightclubs playing music at potentially ear damaging volumes. The venue has a duty to protect its employees e.g. providing barstaff with earplugs etc. however the customers have a choice to enter or leave the environment. That is certainly my understanding but I would be interested in any definitive information on noise levels.
